Terms of Service
These terms govern your access to and use of Callez.ai and related services. By using Callez, you agree to them.

1. Agreement to these terms
Callez.ai ("Callez," "we," "us," or "our") provides a cloud platform for AI-assisted outbound calling, campaign management, analytics, and related features (collectively, the "Services"). These Terms of Service ("Terms") form a binding agreement between you and Callez.
If you access or use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
2. Description of the Services
Callez allows you to configure AI voice agents, run outbound call campaigns, integrate with CRMs and other tools where available, and review call outcomes and analytics. Features may vary by plan. We may modify, suspend, or discontinue parts of the Services with reasonable notice when practicable, consistent with our product roadmap and legal obligations.
3. Accounts and eligibility
You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity under your account. You must be at least eighteen (18) years old and able to form a binding contract to use the Services.
We may refuse service, close accounts, or limit access if we reasonably believe you have violated these Terms, pose a security or compliance risk, or use the Services in a manner that could harm Callez, our customers, or third parties.
4. Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, harassing, defamatory, or discriminatory purposes.
- Send calls or messages that violate applicable telemarketing, privacy, or communications laws (including applicable do-not-call and consent rules).
- Attempt to bypass usage limits, security controls, or billing, or to probe, scan, or test the vulnerability of our systems without authorization.
- Reverse engineer, decompile, or attempt to extract source code or models from the Services except where prohibited by law.
- Resell or sublicense the Services without our prior written consent.
5. Customer data and AI outputs
You retain ownership of data you submit to the Services ("Customer Data"), such as contact lists, scripts, and configuration. You grant Callez a non-exclusive license to host, process, and use Customer Data solely to provide, secure, and improve the Services as described in our Privacy Policy.
AI-generated content (e.g., call dialogue, summaries) is provided for your business use. You are responsible for reviewing outputs for accuracy and suitability before relying on them, especially where they affect customers or regulated activities.
6. Compliance with calling and messaging laws
You are solely responsible for compliance with all laws and regulations that apply to your use of the Services, including but not limited to telemarketing, recording consent, emergency services, and industry-specific rules (e.g., financial services, healthcare) in every jurisdiction where you operate.
Callez may provide configuration options or documentation to support compliance, but we do not provide legal advice. You should consult qualified counsel regarding your obligations.
7. Fees, trials, and payment
Fees for paid plans are described at checkout or in your order form. Unless stated otherwise, subscriptions renew automatically at the end of each billing period until cancelled. Taxes may apply in addition to stated fees.
Trial and promotional offerings may be modified or withdrawn. If you exceed usage included in your plan, overages or upgrades may apply as disclosed in your plan terms.
8. Intellectual property
Callez and its licensors own all rights in the Services, including software, branding, and documentation, subject to the limited rights expressly granted to you. Except as permitted in these Terms or by law, you may not copy, modify, distribute, or create derivative works of the Services.
9. Confidentiality
Each party may receive non-public information from the other ("Confidential Information"). The receiving party will use reasonable care to protect Confidential Information and use it only for the purpose of these Terms. Exceptions apply to information that is public, independently developed, or rightfully received from a third party.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR SUITABLE FOR ANY SPECIFIC PURPOSE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER CALLEZ NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS.
CALLEZ'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO CALLEZ FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF NO FEES APPLIED, ONE HUNDRED U.S. DOLLARS (USD $100)).
12. Indemnification
You will defend and indemnify Callez and its affiliates, officers, and employees against any third-party claims, damages, and costs (including reasonable attorneys' fees) arising from your use of the Services, your Customer Data, or your violation of these Terms or applicable law, except to the extent caused by Callez's willful misconduct.
13. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay amounts due, or if we must do so to comply with law or protect the security of the Services.
Upon termination, your right to use the Services ceases. Sections intended to survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.
14. Changes to the Services or Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. For material changes, we may provide additional notice (e.g., email or in-product notice). Continued use after the effective date constitutes acceptance of the revised Terms, except where applicable law requires separate consent.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Subject to applicable law, courts in Delaware will have exclusive jurisdiction, unless you qualify for protections that cannot be waived in your country of residence.
16. General
These Terms, together with our Privacy Policy and any order form or enterprise agreement you sign with Callez, constitute the entire agreement regarding the Services. If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver.
